What is child abuse, neglect, and abandonment in Idaho?

Under Idaho law, child neglect is when a child: 

  • Is young and left alone
  • Lives in a house where health or safety hazards are present
  • Has no home or emergency shelter
  • Has nothing to eat and appears hungry and underweight
  • Is without education

Child physical abuse means harming a child in a way that leaves physical marks or injuries.

Child sexual abuse is the use of a child in a sexual way and is often underreported for a variety of reasons. It may be sexual touching, molestation, incest, rape, or taking pictures of a child for obscene or pornographic purposes.

Child abandonment means the failure of the parent to maintain a normal parental relationship with their child including, but not limited to, reasonable support or regular personal contact.

According to the Child Welfare League of America, there were 1,958 victims of abuse or neglect in Idaho in 2020, a rate of 4.3 per 1,000 children. This is a 2.4% increase since 2016.

Who is a mandated reporter according to ID state requirements?

Everyone in Idaho is required to report child abuse, neglect, or abandonment within 24 hours. This includes doctors, hospital residents, therapists, interns, nurses, coroners, school teachers, daycare providers, social workers, relatives, friends, and private citizens. 

Idaho has only one exception for mandatory reporting for a “duly ordained minister of religion.”

Local Law Enforcement: 2-1-1 and be transferred

Child Protection’s role is limited to what may be happening in a family home. If a child is the victim of maltreatment by an individual not living in the home, such as a neighbor, family friend, or relative, the report is forwarded to law enforcement.

However, if there are concerns that the child’s parents are unwilling or unable to protect the child from further harm, child protection may proceed with a safety assessment.
